{"id":5046,"date":"2020-07-17T15:56:46","date_gmt":"2020-07-17T22:56:46","guid":{"rendered":"http:\/\/www.cwa9003.org\/?p=5046"},"modified":"2020-07-17T15:56:48","modified_gmt":"2020-07-17T22:56:48","slug":"questions-about-the-att-buyout-and-unemployment","status":"publish","type":"post","link":"http:\/\/www.cwa9003.org\/?p=5046","title":{"rendered":"Questions about the AT&#038;T buyout and Unemployment"},"content":{"rendered":"\n<p>We\nare receiving a lot of questions about whether or not AT&amp;T employees who\ntake a voluntary buyout will be eligible to receive unemployment benefits.<\/p>\n\n\n\n<p>We\nhave received the following information from CWA District 9:&nbsp;<\/p>\n\n\n\n<p>Historically, the Company&#8217;s position is to fight all unemployment\nclaims regardless of the separation reason.&nbsp; <\/p>\n\n\n\n<p>Only the EDD office makes the determination if an applicant\nqualifies for unemployment benefits.&nbsp;<\/p>\n\n\n\n<p>The EDD&#8217;s internal process is:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Applicant applies for unemployment benefits (utilizing the website expedites the process) <\/li><li>The application is reviewed by an EDD Agent\u00a0<\/li><li>The company receives notification of the request for benefits <\/li><li>The EDD notifies the applicant if they were awarded or denied for benefits<\/li><li>The applicant has an opportunity to appeal (phone interview)<\/li><li>If the applicant is denied after the phone interview they may appeal to an EDD Judge (face to face hearing)<\/li><li>The company may elect to send a representative\u00a0<\/li><li>If the applicant is denied after the face to face hearing, then their last opportunity for appeal is with the state<\/li><\/ul>\n\n\n\n<p>Suggestions for interview process:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Supply EDD Agent copies of news articles and AT&amp;T News Informer emails addressing downsizing of the business regardless if your job title is listed or not <\/li><li>Copy seniority list\u00a0<\/li><li>Copy of any notification of surplus or layoff (those beneficial to receiving EDD benefits) <\/li><li>Answer a direct question with a direct answer (don&#8217;t supply additional information i.e. I left with a bonus incentive)<\/li><li>If asked, you must advise you received a severance payment <\/li><\/ul>\n\n\n\n<p>EDD website:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Benefit determination guide index\u00a0\u00a0<a href=\"https:\/\/edd.ca.gov\/UIBDG\/\">https:\/\/edd.ca.gov\/UIBDG\/<\/a><\/li><li>File a claim\u00a0 <a href=\"https:\/\/edd.ca.gov\/unemployment\/File_an_Unemployment_Insurance_Claim.htm\">https:\/\/edd.ca.gov\/unemployment\/File_an_Unemployment_Insurance_Claim.htm<\/a><\/li><li>After you file a claim\u00a0 <a href=\"https:\/\/edd.ca.gov\/unemployment\/After_you_Filed.htm\">https:\/\/edd.ca.gov\/unemployment\/After_you_Filed.htm<\/a> (COVID-19 information)<\/li><li>COVID-19 information\u00a0\u00a0<a href=\"https:\/\/www.ca.gov\/serp\/?q=unemployment\">https:\/\/www.ca.gov\/serp\/?q=unemployment<\/a><\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>We are receiving a lot of questions about whether or not AT&amp;T employees who take a voluntary buyout will be eligible to receive unemployment benefits.
